The High Court on Monday directed the State government to respond to a petition seeking a directive to arrest Franco Mulakkal, bishop of the Jalandhar diocese of the Catholic Church, in a case charging him with sexually abusing a nun.
The directive was passed by Justice B. Sudheendra Kumar when the petition filed by K. George Joseph, executive committee member of the Kerala Catholic Church Reformation Movement (KCRM), Pala, came up for hearing. Justice Sunil Thomas had last week recused himself from hearing a petition.
The petitioner pointed out that despite registering an FIR on June 28 and recording the statement of the nun under Section 164 of the Code of Criminal Procedure, the bishop was yet to be arrested or interrogated.
As a result, the survivor was facing threat to her life.
The slow progress in the investigation amounted to violation of the right of the sexual abuse survivor to life.
The petitioner sought a speedy investigation besides the protection of witnesses. Moves were afoot to undermine the investigation by threats, inducements and coercion on witnesses, the petitioner alleged.
